@luis faws The definition of “serious health condition” must be met in order for an employer to have to designate leave as FMLA. Many employees wrongly believe their employer or manager can’t ask questions to them or their healthcare provider or require more information. Not all questions will be appropriate, but many are. Not all “surgeries” will meet the definition of “serious health condition.” Surgeries can range from quick and mild to extensive. And some are only cosmetic in nature and may be excluded from being covered by FMLA. The FMLA defines a serious health condition as an illness, injury, impairment, or physical or mental condition that involves either inpatient care or continuing treatment by a health care provider. Both physical and mental health conditions qualify for FMLA leave. For more information on the definition, please visit the Department of Labor as I only showed a portion of it in my video. There are other reasons employees can get FMLA as well, as long as they are eligible, haven’t already used all of their time, and their employer is required to provide it. Managers also need to know this information.
